Belgium packaging EPR in 2026: Fost Plus, Valipac and the producer test
Belgium splits household and industrial packaging before it asks who the producer is. Match the stream, then trace the invoice chain that puts the filled pack on the market.

Short answer: Belgium asks two questions in sequence: which packaging stream you place (household through Fost Plus, commercial or industrial through Valipac, or an approved individual route), and which legal entity first makes that packaging available under the interregional cooperation agreement. Belgium national guidance
Fost Plus, Valipac and the stream split
Household packaging and commercial or industrial packaging follow different operational paths. Fost Plus covers the household stream; Valipac covers commercial and industrial packaging, including wood. The authority also permits individual compliance with its own reporting and take-back evidence.
That split comes before you argue about materials. A pallet wrap and a consumer sales box can share a polymer family yet land on different declarations if their use category differs. Keep two ledgers if both streams appear in your Belgian sales. Belgium packaging source
Who legally first places the pack in Belgium?
The cooperation agreement applies across Flanders, Wallonia and Brussels. The responsible company is not whoever hosts the webshop or stores stock. It is the packer, importer or, in some flows, the business that unpacks imported goods and first makes packaging available in Belgium.
Write down the legal seller, who fills the pack, the import arrangement and the recipient. Compare that chain to the national definition before you copy a distributor's membership number into a return. Belgium national rules
Building the material record from components
National guidance lists glass, paper and cardboard, steel, aluminium, plastics, beverage cartons, cork, wood and other materials. That list maps families; the live register or scheme form may split plastics, composites, functions or customer streams further. Belgium material guidance
For each SKU, list the sales pack, insert, label, shipping carton, film, pallet and service packaging. Weigh the packaging component, not the product. Count only quantities first placed in Belgium. Use the form's line codes, not bin colours, as fee or reporting codes. Belgium material source
Thresholds teams confuse with exemptions
The Belgian authority describes an annual reporting obligation for companies placing packed products on the market. Take-back duty starts above 300 kg, while prevention plans use separate 100- and 300-tonne tests. Those figures answer different legal questions. Record which test applies to your volume rather than treating 300 kg as a universal pass. Belgium authority and scheme sources
How to complete the Belgium route
Register entry, scheme or recovery contract, and quantity report stay separate files even when one organisation hosts two steps. Belgium national guidance
- Split household from commercial or industrial packaging, then name the legal seller, importer and first placer for each Belgian route.
- Open the register or scheme route that matches the stream and record the producer identity the chain supports.
- Break shipments into components and map weights to the material families on the current form.
- Submit on the live calendar and reconcile kilograms with sales, imports and returns for that period.
- Archive register evidence, contracts, any representative mandate and the quantity report together but distinctly.
Checklist before you file in Belgium
Wrong stream choice survives a perfect weight spreadsheet.
- Household and industrial quantities separated before scheme selection.
- Producer identity traced from invoices, not from marketplace branding.
- Component weights tied to form lines, not to collection-label colours.
- 300 kg take-back and prevention-plan thresholds checked against your actual role.
- Register proof, scheme contract and declaration filed under the same legal entity and period.
Mistakes that break a Belgium return
Pasting a Fost Plus member ID into Valipac data, or the reverse, is common when one brand sells B2B and D2C from the same catalogue. Fix the stream first.
A scheme invoice is not registration proof if nobody can explain who first placed the pack. Cross-border sellers also import producer numbers from other Member States. The EU Packaging and Packaging Waste Regulation (PPWR) has applied generally since 12 August 2026, but it does not issue one EU producer number. Read its registration and representative rules next to this national route, and confirm establishment, direct-to-end-user sales and who is actually registered before you sign a mandate.
Common questions about Belgium packaging EPR
Must every Belgian producer join both Fost Plus and Valipac? No. The stream matters: household packaging is associated with Fost Plus and commercial or industrial packaging with Valipac. The authority also recognises individual fulfilment, with its own reporting and take-back evidence. Recheck the live Belgium form before you treat this as filed. Belgium national guidance
Does every Belgium material sit on one declaration line? No. The families listed here are glass, paper and cardboard, steel, aluminium, plastics, beverage cartons, cork, wood and other materials. The current register or scheme form may split plastics, composites, functions or customer streams further. Use that form, not a household bin colour, as the fee or reporting code. Belgium material guidance
Does a Belgium scheme contract replace registration? A contract can cover defined collection and recovery work. The producer still has to complete any separate Belgium registration and data-reporting step and keep those records aligned. Belgium national guidance
Can one EU filing cover Belgium? No. Keep a Belgium file for packaging first placed there, with its own responsible party, material ledger and evidence. A number issued in another Member State does not prove Belgium compliance. PPWR
For the authority, law and the live country checks, use the Belgium country page. The 27-country EPR overview shows how to keep one packaging ledger while filing each market separately. The applicability test is the right first step if the producer role is still unclear.
