How to check if EPR applies to your business
EPR is not a company-wide yes or no. Split the item, the waste stream, the destination and the legal seller, then apply only that country's rule.

Short answer: "Does EPR apply to my business?" is a set of decisions, not a company-wide stamp. Extended producer responsibility attaches to particular products and packaging, in particular markets, under a legally defined producer role. An online seller can owe packaging EPR in one destination, have no packaging registration in another, and still need a separate electrical or battery check for the same SKU. Work in this order: item, stream, market, responsible entity, then that country's threshold and filing route. PPWR producer definition
What the producer test actually asks
The Packaging and Packaging Waste Regulation has applied generally since 12 August 2026. It defines who is a packaging producer, including certain cross-border direct sellers, and it requires national producer registers. It does not tell you that your company "has EPR" as a whole.
smbf.me is packaging EPR software. It can import store orders, map destination countries and hold packaging data and evidence. It is not legal advice, not a scheme, not an authorised representative, and not one EU registration. Electrical equipment and batteries sit on other registers; include them in this check so you do not treat a packaging file as a device file.
Take one representative order and separate the physical things: the product, its retail pack, shipping carton, tape, inserts, protective film, and any battery or electrical part. Record material or product category and mass. A free insert or spare can still count, because the tests look at making goods available, not only at the price charged. Shipment weight alone cannot tell you which stream applies.
Why a borrowed threshold is the usual trap
Marketplaces and finance teams want a yes or no. The cheap answer is to copy a tonne figure from a blog or from another country's fee table. Sweden's agency says packaging producer responsibility applies regardless of the packaging quantity first supplied on the Swedish market. ZSVR tells packaging producers to register in LUCID; a small-volume reporting simplification is not a general exclusion from registration. Swedish packaging guidance, ZSVR reporting guidance
If you skip the entity question, you also file under the wrong group company or treat an importer's number as yours. The 27-country packaging EPR list is the map after this test, not a substitute for it.
Spreadsheet ticks and borrowed tonne figures
Finance teams often want a single spreadsheet column labelled "EPR" with a tick per country, filled from a dual-system invoice or a marketplace hint. Others treat "we are small" as a Union exemption, or assume a local importer already covered every stream.
That holds until someone asks for the source. You cannot show which item, which stream, which legal seller and which period produced the tick. A rechargeable speaker then sits in a packaging-only folder while the device and battery were never tested.
How to run the check here
Keep a decision row per product, destination and stream. In smbf.me, start from the order and the destination map so the packaging lines are not invented from a shipping total.
- Split a real order into the product, each packaging component, and any electrical or battery part, with material and mass.
- Match each line to a regulated stream such as packaging, electrical equipment or batteries, and save the source that defines it.
- Name the destination and the legal entity that first makes that item available there.
- Apply only that stream's threshold and filing rule in that country; do not reuse a skip from another market.
- Write a dated applies, does not apply, or needs a fact decision with entity, source URL and evidence.
The Netherlands government lists six national EPR product groups, including packaging, electrical equipment, batteries, textiles, vehicles or tyres, and single-use plastics. Germany splits the first three across LUCID and stiftung ear. A product nickname such as "smart accessory" does not choose a category. Dutch EPR overview, stiftung ear producer overview, ZSVR LUCID guide
The destination question is not "do we sell in Germany?" It is "which entity first makes this packaged product, this device or this battery available in Germany under that stream's rule?" Direct sales to end users and sales through an independent local importer can produce different answers. The Germany country page shows the packaging split; electrical and battery routes stay on stiftung ear.
Thresholds differ in what they measure and which duty they change. Do not import a size test from a non-EU packaging regime into an EU Member State file. Inside the Union, treat Ireland's major-producer extra duties and Belgium's 300 kg take-back line as local examples, not as a Union skip. Re-run the row when you add a market, change a pack, switch from distributor sales to direct sales, or cross a published local limit.
Checklist before you record "applies" or "does not apply"
Follow the five steps above in order. A registration number added later does not fix a wrong stream or seller.
Before you lock the row, check that weights are material-level (not parcel totals), each stream has a primary-source link, the legal seller for that destination is named, thresholds come only from that country's text, and the dated decision could survive an auditor's question.
Mistakes that make the decision impossible to defend
Teams weigh the whole parcel and call that the packaging quantity. The product mass is not the pack mass. Component weights, sales counts and returns have to support the kilogram file later.
Generic supplier "compliance certificates" with no product, country, stream or period fail the same audit. Ask for those four facts. If they are missing, the certificate does not close your producer test.
Treating LUCID, a French IDU or a CONAI number as proof that packaging EPR applies, or does not apply, in every other Member State is a separate error. Those identifiers answer one national register. Recheck the producer definition where the pack is first made available.
Common questions about whether EPR applies
Does selling only online avoid EPR? No. Producer tests can name distance sales explicitly. Record the legal seller and who first makes the pack, device or battery available in that country. A warehouse abroad does not, by itself, remove a destination duty. PPWR
Does a small quantity mean I skip registration? There is no Union-wide EPR minimum. Sweden's environmental agency says packaging producer responsibility applies regardless of the quantity first supplied. Germany's ZSVR still expects a LUCID registration; a small-volume reporting simplification is not a general exclusion. A size test found in another country's notes must not be reused as a producer skip. Sweden, Germany
Does a marketplace registration replace mine? Do not assume so. Check whether the marketplace is legally the producer for that stream and transaction, or only checks that the seller holds a number. Ask which products, countries, streams and periods any supplier certificate actually covers.
If I have LUCID, does packaging EPR apply everywhere in the EU? No. LUCID answers the German packaging register. Other Member States keep their own producer registers and scheme routes. Run this check per destination, then open the national checkpoint in the 27-country guide. ZSVR, PPWR
Once a row says packaging EPR applies, open that market in the 27-country packaging EPR guide. For Germany's packaging register, use the Germany country page. After several destinations are in scope, keep them on the multi-country EPR workflow.
