Austria packaging EPR in 2026: scheme, representative and EDM

An ARA invoice, a section 16b mandate and an EDM Annex 3 deadline answer different questions. This guide maps each to the Austrian sales route you actually run.

Short answer: Austrian packaging EPR is three instruments that people collapse into one invoice. An obligated business identifies packaging it first places on the Austrian market, joins an approved collection and recovery system where required, and keeps material quantities. A distance seller without an Austrian seat or branch that supplies packaged goods directly to private end users must appoint an authorised representative under section 16b of the Packaging Ordinance. Some parties also file Annex 3 on EDM when packaging is not covered by a system. Those records are separate. BMLUK transition factsheet; USP on representatives.

Which Austrian sale creates the packaging duty?

Start with the goods flow, not the shop's hosting country or a VAT number. The Austrian business portal (USP) describes Primärverpflichtete, the parties primarily responsible for packaging placed on the market: manufacturers or importers of service packaging, packers, importers of packaged goods and certain own importers, among others. Distance selling is a method of supply, not a side case. A sale to an Austrian importer is a different role from a parcel to a household. Keep the invoice chain, import arrangement, contractual seller and recipient next to the packaging record. USP: primarily obligated parties; Packaging Ordinance.

For each sale, list the outer sales pack, inserts, shipping box, film, straps and any service packaging. Classify household versus commercial packaging under the national allocation rules; the delivery address alone may not answer that. Scheme tariffs split those streams, and material plus weight affect the contribution. A component list is internal evidence, not an official form. USP: transport and sales packaging; ARA licensing.

Scheme contract, representative mandate and EDM Annex 3 do different jobs

An approved Sammel- und Verwertungssystem takes over the relevant collection and recovery obligations under Austrian waste law. The contract has to match the packaging stream, material categories and reporting period you actually place on the market. ARA is one available system. It is not the name of the statute and it is not a universal authority. Compare the system's approved scope with your SKUs. USP: collection and recovery systems; ARA licensing service.

The authorised representative is a person who performs a foreign seller's Austrian duties under a written mandate. USP and section 16b sit here, not in the tariff sheet. The official process uses the EDM or ZAReg identity route; the ministry checks the power of attorney before marking the person as representative. The representative reports packaging masses placed on the Austrian market for the appointing seller. One company can represent a producer for packaging, WEEE and batteries, but each scope needs a distinct mandate or an unambiguous combined mandate. A WEEE appointment does not cover packaging by silence. USP: mandate and ZAReg.

EDM is Austria's electronic data-management environment. Annex 3 of the Packaging Ordinance covers defined groups, including self-importers, large waste producers and refillers of reusable packaging, where the relevant packaging is not covered by a collection and recovery system. The EDM portal sets an annual Annex 3 deadline of 31 March for the preceding calendar year. Systems submit their own annual reports by 10 April and have additional monthly duties. Those dates do not mean every scheme member personally files Annex 3. EDM: Verpackung reporting.

When section 16b makes the representative mandatory

USP draws a line that commercial teams often blur. An EU or EEA-established foreign person supplying packaging to Austrian buyers other than private end users can appoint a representative. A foreign distance seller with no Austrian seat or branch that supplies packaging or packaged goods directly to Austrian private end users must appoint one. Section 16b of the Packaging Ordinance is the mandatory route for that distance-seller case. Do not treat the optional commercial appointment as a waiver for consumer parcels. USP: representative cases; Packaging Ordinance section 16b.

PPWR has applied generally since 12 August 2026. Read its cross-border producer rules next to the Austrian transition, not instead of it. BMLUK's current factsheet says existing Austrian scheme and reporting provisions remain largely in force pending amendments to the Waste Management Act and Packaging Ordinance. Check the law again at filing time. BMLUK factsheet; PPWR, Regulation (EU) 2025/40.

EDM's official material list includes paper/card, glass, ferrous metals, aluminium, plastics, wood, biogenic materials and composites. A scheme may publish finer tariff classes, including plastic subcategories or a household/commercial split. A yellow-bin colour is not a fee code. Weigh the packaging component, not the product. Household collection changed in January 2025, with plastic and metal packaging outside the deposit system collected together in the yellow bin or bag; that consumer instruction still does not replace the EPR classification. EDM material list; ARA 2026 tariff sheet.

How to complete the Austrian packaging route

Treat scheme, representative and EDM as three files even when one service company holds two of them. smbf.me can prepare a country plan and packaging ledger; it is not an Austrian scheme, authorised representative or the EDM operator.

  1. Name the legal seller, importer and Primärverpflichtete for each Austrian sales route.
  2. Classify household versus commercial packaging and weigh each component against the scheme's current material classes.
  3. Conclude a contract with an approved collection and recovery system that covers the packaging actually placed on the market.
  4. If you are a foreign distance seller without an Austrian seat or branch shipping to private end users, appoint an Austrian representative under section 16b and keep the ZAReg or EDM evidence.
  5. Decide whether Annex 3 on EDM also applies (31 March) besides the system's own report (10 April), then reconcile kilograms to Austrian sales, imports and returns.

Checklist before you treat Austria as filed

Work through the list in order. A scheme invoice does not prove the mandate.

  1. Primärverpflichtete identified from the invoice chain, not from the webshop domain.
  2. Household and commercial packaging separated under Austrian rules.
  3. Component weights mapped to the chosen system's current classes.
  4. Approved-system contract in force for the packaging in scope.
  5. Section 16b representative appointed where the distance-seller test is met, with accepted mandate evidence.
  6. Annex 3 on EDM either filed by the right party or documented as not applicable.
  7. Kilograms reconcilable to Austrian sales, imports, returns and the reporting period.

Mistakes that mix scheme, representative and EDM

Teams treat an ARA membership number as proof that a foreign consumer-parcel seller is represented. Section 16b is a statutory appointment with a ministry check on the power of attorney. The scheme finances collection for covered packaging. It does not appoint the representative.

Others copy 31 March into every calendar because EDM published it. Annex 3 is for packaging that is not in a system, for named groups. System annual reports run to 10 April. If you are a scheme member for those tonnes, you still need to know who reports what; you do not automatically become an Annex 3 filer.

A third pattern is using a WEEE representative mandate as packaging cover, or assuming PPWR issued one EU producer number for Austria. Keep packaging, WEEE and batteries as separate scopes. Recheck BMLUK before you retire the current scheme route.

Common questions about Austria packaging EPR

Does an ARA contract replace an Austrian representative? No. An approved collection and recovery system takes over defined collection and recovery duties for covered packaging. A foreign distance seller without an Austrian seat or branch that supplies packaged goods directly to private end users must still appoint a representative under section 16b. ARA is one available system, not the Packaging Ordinance and not a substitute for the mandate. USP on representatives.

Must every scheme member file Annex 3 on EDM by 31 March? No. EDM Annex 3 is aimed at groups such as self-importers, large waste producers and refillers of reusable packaging where the relevant packaging is not covered by a collection and recovery system. The portal's 31 March deadline is for that return. Systems submit their own annual reports by 10 April. Identify who files, through which account, before you copy those dates into a calendar. EDM reporting.

Can an EU commercial representative skip §16b for consumer parcels? A person established in another EU or EEA state that supplies packaging to Austrian buyers other than private end users may appoint a representative. Direct distance sales to private end users, with no Austrian seat or branch, are the mandatory section 16b case. The optional commercial route is not a waiver for household parcels. Section 16b.

Does PPWR already replace the Austrian scheme route? PPWR has applied generally since 12 August 2026. BMLUK's factsheet says existing Austrian scheme-participation and reporting rules largely continue while national amendments are prepared. Recheck the law at filing time rather than assuming a new EU portal has replaced EDM or the system contract. BMLUK factsheet.

For the regulator, legal basis and live country checks, use the Austria country page. The 27-country EPR overview shows how to keep one ledger while filing each market separately. The applicability test is the first step if the producer role is still unclear.
